Our legal documents were authored in French. Translations in English and other languages are pending jurisdictional review by local counsel. In case of discrepancy, the French version prevails.
The platform oradata.ai(hereinafter “the Platform”) is published by OraData LLC, a limited liability company registered in the State of Minnesota, USA, with its registered office in Bloomington, Minnesota. Contact: support@oradata.ai.
The Platform's purpose is the collection, annotation, certification, and commercialization of training data for artificial intelligence, across languages, medicinal flora, medical imaging, domestic gestures (Physical AI), extreme-condition roads, and agriculture.
Registration is free and open. It requires: verifiable legal identity (valid ID uploaded), a valid email address, country of residence, and acceptance of these Terms. Freelancers must also pass a qualification test per targeted vertical.
OraData reserves the right to refuse or suspend any account in case of (a) misrepresentation, (b) violation of the Golden Rule, (c) fraud attempts, or (d) behavior contrary to applicable laws.
All data uploaded or generated on the Platform becomes the exclusive property of OraData LLC upon validation and payment to the contributing Freelancer. This assignment is worldwide, perpetual, irrevocable, and includes all rights of exploitation, reproduction, modification, adaptation, commercialization, and sublicensing.
The Freelancer warrants that they are the legitimate creator of the uploaded Content, that they hold all necessary authorizations from persons appearing in the Content (image/voice consent), and that said Content does not infringe any third-party copyright, confidentiality obligation, or applicable law.
No User, regardless of status or tier, is authorized to validate, annotate, or certify data they uploaded or collected themselves. The Platform enforces this rule technically (three-layer SQL database control: CHECK constraints, BEFORE INSERT triggers, and Row Level Security policies), and any bypass attempt results in immediate account suspension.
OraData applies a reliability scoring system (reliability score, Cohen's Kappa, gold items) to each Freelancer. Sustained score degradation may result in tier demotion, temporary suspension, or permanent deactivation. These mechanisms are detailed in Article 12 of the Freelance Agreement (Part B).
Any violation results in immediate account suspension or termination and, where applicable, legal action.
OraData strives for continuous Platform availability but cannot guarantee 100%. Planned (maintenance) or fortuitous (outage) interruptions may occur. OraData is not liable for indirect losses, lost revenue, or lost opportunities resulting from such interruptions.
OraData's liability towards any User is in any case limited to the total amount of payments made to/by the User in the 12 months preceding the event, up to a maximum of USD 10,000.
OraData may amend these Terms at any time. Substantial changes are notified to Users by email 30 days before taking effect. Continued use of the Platform beyond that period constitutes acceptance of the changes.
These Terms are governed by the law of the State of Minnesota, USA. Any dispute is subject to a prior 60-day mediation procedure. Failing agreement, the parties accept the exclusive jurisdiction of the federal courts of the District of Minnesota, Minneapolis Division, subject to mandatory overriding rules of the User's country of residence.
